Terms & Conditions for Use of Fraunhofer Example Source Code 

The example source code which links to this document (hereafter "Example Source Code")
is subject to all of the following terms and conditions. By using the Example Source Code,
you agree to all of these terms and conditions:

1. Fraunhofer ("Fraunhofer") grants to you a non-exclusive, non-assignable copyright license
   to make and distribute copies of the Example Source Code, and to distribute modified versions
   of the Example Source Code that are provided in source code (human readable) form.
   Fraunhofer grants to you a non-exclusive, non-assignable copyright license to use parts or all 
   of the Example Source Code within products that you distribute under your own brand name.

2. You shall distribute the Example Source Code, any portion thereof, or any modifications to the 
   Example Source Code to third parties solely under the provision that you include these Terms & Conditions
   for Use of Fraunhofer Example Source Code in any such distribution. Modifications to the Example Source 
   Code must be marked. 

3. Title to the Example Source Code and all copies thereof remain with Fraunhofer or its suppliers.  
   The Example Source Code are copyrighted and are protected by German copyright laws and international 
   treaty provisions.  You will not remove any copyright notice from the Example Source Code. You agree
   to prevent any unauthorized copying of the Example Source Code.  Except as expressly provided herein, 
   Fraunhofer does not grant any express or implied right to you under Fraunhofer patents, copyrights, 
   trademarks, or trade secret information. Subject to Fraunhofer's ownership of the Example Source Code, 
   all right, title and interest in and to your modifications shall belong to you.

4. With the exception of wilful misconduct and gross negligence the Example Source Code are provided 
   "AS IS" without warranty of any kind. FRAUNHOFER OFFERS NO WARRANTY EITHER EXPRESS OR IMPLIED INCLUDING
   THOSE OF MERCHANTABILITY, NONINFRINGEMENT OF THIRD- PARTY INTELLECTUAL PROPERTY OR FITNESS FOR A PARTICULAR 
   PURPOSE. FRAUNHOFER SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES 
   FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS) ARISING 
   OUT OF THE USE OF OR INABILITY TO USE THE EXAMPLE SOURCE CODE, EVEN IF FRAUNHOFER HAS BEEN ADVISED OF THE 
   POSSIBILITY OF SUCH DAMAGES.   

5. You agree that any material, information or other communication you transmit or post to a Fraunhofer website
   or provide to Fraunhofer under this Agreement will be considered non-confidential and non-proprietary 
   ("Communications"). Fraunhofer will have no obligations with respect to the Communications. You agree that 
   Fraunhofer and its designees will be free to copy, modify, create derivative works, publicly display, disclose, 
   distribute, license and sublicense through multiple tiers of distribution and licensees, incorporate and otherwise 
   use the Communications and all data, images, sounds, text, and other things embodied therein, including derivative 
   works thereto, for any and all commercial or non-commercial purposes. 
6. APPLICABLE LAWS: Any claim arising under or relating to Example Source Code shall be governed by the laws of the 
   Federal Republic of Germany, without regard to principles of conflict of laws. The United Nations Convention on 
   Contracts for the International Sale of Goods of April 11, 1980 shall not apply. You may not export the Example 
   Source Code in violation of applicable export laws.
